SSB for 3DS Smash Ballot rulesrules

Even though it may not occur to some people, here are 3 rules that I think are implied when they select characters from the ballot:
  1. Characters that are assist trophies, stage hazards, bosses, in final smashes, or in the background are not able to join the battle. (Examples: Shadow, Tails, Nabbit, Ridley, etc.)
  2. Characters whose IP is no longer and/or on Nintendo platforms cannot enter. (Examples: Banjo-Kazooie, Kratos, Master Chief, etc.)
  3. As long as characters have at least one good game on a Nintendo platform, they can join unless they break both of rules 1-2

  1. This is pretty much confirmed all over. It's kind of dumb to have characters as playable and a part of something else (sorry Waluigi fanboys)
  2. This one can go either way actually. Ryu was added and his series is on Playstation, not really on Nintendo. I was gonna use Snake as an example but he wasn't put because of bad relations.
  3. This is probably true because that's the main reason Ness and Lucas are still in the series.
The only exception to all of these in the current toster is ROB, the toy :D

I think Ryu was on the SNES and Wii besides the 3DS. Capcom is a 3rd party and isn't really limited to any company's console. Ness and Lucas were in probably because of Sakurai, if it weren't for him as director they may not have even existed. I'm sure Sakurai has general rules he follows in regards to choosing which character he'll put in. Drop out characters go first, popularity second, the importance of the series in the gaming community third.
 
Isn't Toon Link a background character in the Spirit Tracks stage so that kinda breaks rule one? Just kidding, but I thought the primary rule involved the fact that the character that is chosen has to originate from a video game franchise, which is why Batman will never work. Plus, Sakurai mentioned something about choosing characters that will still hold some kind of relevance in the future. And then characters like Lucas and Roy whom have no apparent future were still added back due to the immense amount of requests by the fans.

Snake's franchise first started with a game on the NES by the way.

Lucas and Roy followed rule 3. Snake did not break rule 2.

Lucas and Roy do not even apply to the rules because they weren't a part of the ballot and were only added due to overwhelming request. As for Snake, his recent game on a Nintendo platform was the 3DS so I think his chances are good, so yeah he didn't break rule 2.
